The existing gambling legislation in Brazil lacks a general statute or regulatory framework for the authorization of relevant games. Legal gambling practices imply that gaming establishments must meet various licensing standards depending on the type of gambling offered. Only states can own federal lotteries.

Caixa, a Brazilian bank, was given management of the federal lottery as a result of a decree issued in 1961. The order revoked all private lottery licenses. The permits are federal government concessions, and the institution grants the licenses for the buildings.

Approximately 13,000 lottery venues in operation are licensed by Caixa. The agency also provides ten different types of lotteries. Government officials are continuously considering privatizing LOTEX to break the system's monopoly.
