What is the legal status of Casinos in China?
Mainland China prohibits commercial casino gambling, including online casinos. The prohibition dates to 1949 and sits today in Article 303 of the Criminal Law of the People's Republic of China, which criminalises gambling for profit and the running of a gambling house. Amendments in the last two decades have been used against online operations and against businesses that organise gambling aimed at Chinese citizens, including from overseas. Two state products sit outside that casino prohibition. The Welfare Lottery launched in 1987 and the Sports Lottery in 1994. The Ministry of Finance supervises lottery operations. The government does not classify those lotteries as gambling. Buying a ticket from an authorised vendor is the lawful nationwide path. Websites that sell "lottery" as an offshore casino product are not the Welfare Lottery.
Macau is the only part of China where licensed casino gambling is legal. Concessionaires operate land casinos under the Gaming Inspection and Coordination Bureau. Online casinos are not part of that system. Law 20/2024, the Law to Combat Illegal Gambling Crimes, took effect on 29 October 2024 and treats unauthorised online games of chance as a criminal offence, including where servers sit outside Macau. Hong Kong licences horse racing and the Mark Six lottery through the Jockey Club. It does not licence casinos.
There is no personal-income-tax schedule for illegal casino winnings, because the activity is not a lawful income category. Welfare and Sports Lottery prizes above 10,000 yuan are commonly described as subject to 20% tax. That lottery rule does not legalise an offshore baccarat payout.
